1. TERMS & CONDITIONS OF SALES

ORDERS & PAYMENT

Hosting and Payment Provider: Our website is hosted on the Wix.com platform. The payment provider we use is Wix Payments. All direct payment gateways offered by Wix.com and used by the Kali Forbes business adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express, and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

Order Cancellation: Kali Forbes reserves the right to cancel an order, or part thereof, if a product becomes unavailable, we do not deliver to your area, or if one or more of the goods you ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by us from our suppliers. We will refund the relevant amount but will not be liable for any other costs incurred as a result of the unavailability.

Payment Confirmation: Please check your invoice/sales receipt carefully as items will be supplied as per this. We require full payment to confirm your order and begin production.

Right to Refuse Orders: Kali Forbes reserves the right to cancel or refuse to accept an order due to erroneous information or payment not being received.

DELIVERY

Non-Binding Estimates: Delivery dates given on this site are non-binding estimates based on the best available information concerning manufacturers' lead times and transportation schedules. Orders may be shipped on, prior to, or after the estimated date, with prior notification to the buyer.

International Delivery: For all overseas customers (including those in the EU from 1st January 2021), goods are delivered DAP/DDU. This means that any customs duties or local taxes, including VAT for EU customers, must be paid by the customer upon import. Additionally, there may be a customs clearance fee charged by the shipping company, which varies from country to country.

Specific Delivery Conditions: Specific delivery conditions requested by the buyer should be given at the time of order placement, and charges may change accordingly.

Inspection of Deliveries: Customers should inspect deliveries as quickly as possible for any damage and inform us within 7 days. After 7 days, the goods will be deemed to have been accepted as undamaged by the customer.

RETURNS, REFUNDS & EXCHANGES

Warranty Claims: When we receive a valid warranty claim for a product purchased from us, we will either repair the relevant defect or replace the product. If we are unable to repair or replace the product within a reasonable time, the customer will be entitled to a full refund upon the prompt return of the product to us. We will pay for shipment of repaired or replaced products to the customer, and the customer will be responsible for return shipment of the product to us.

KEY COMMERCIAL TERMS

Consumer Rights: It is our responsibility to supply you with goods that meet your consumer rights. If you have any concerns that we have not met our legal obligations, please contact us by sending an email to info@kaliforbes.com.

CLAIMS

In-Transit Damage and Order Shortages: Claims for in-transit damage and order shortages must be notified to Kali Forbes within 7 days of delivery. Failure to make such claims within the specified time constitutes acceptance of the merchandise and quality thereof.

Damage After Delivery: We will not accept claims for damage resulting from storage by the buyer or for damage and faults resulting from accident, negligence, alteration, or misuse after delivery.

Faulty Products: Claims for faulty products must be made via email. Proof of purchase will be required. Photographic evidence and/or returned products may be required when claims are being made.

Retailer Purchases: If products were bought through a retailer and not directly from this website, please make claims to that retailer.

DISPUTE RESOLUTION

These terms and conditions shall be governed by and construed in accordance with the laws of England and you irrevocably submit to the exclusive jurisdiction of the courts of England.

2. BESPOKE SALES POLICY

I, Kali Forbes, am delighted to offer bespoke jewellery services. Creating a piece of jewellery that signifies the important milestones in my clients' lives is always an honour. I aspire to design and craft jewellery that you and your loved ones will enjoy wearing and cherish for many years to come. Please read the following terms and conditions carefully before commissioning a bespoke item. By commissioning a bespoke piece, you agree to be bound by these terms and conditions.

CONSULTATION, DESIGN & PAYMENT

Initial Consultation: An initial design consultation will be arranged to discuss the Client's requirements, preferences, and budget. This consultation may be conducted in person, via phone, or online.

Design Deposit: Following the initial consultation, if the Client wishes to proceed with the commission, a non-refundable design deposit is payable. This deposit is deductible from the total price of the commission upon successful completion.

Design Proposal: Upon receipt of the design deposit, Kali Forbes will provide a design proposal within 4 weeks. The proposal may include sketches, computer-generated imagery, descriptions, and estimated costs. Any costs/quotes associated with the commission will be valid for 30 days.

Design Approval and Payment: The Client must approve the final design in writing and make a payment either for the full amount, minus the design deposit, or for half of the remaining total, before any work begins. Any changes requested after approval of the final design may incur additional charges.

Final Payment: The remaining balance is due upon completion of the bespoke jewellery, prior to delivery or collection.

CHANGES & CANCELLATIONS

Design Changes: Any changes to the design after approval must be requested in writing and may incur additional charges. Kali Forbes will provide a revised quotation for the Client's approval.

Cancellations: The Client may cancel the commission at any time. However, the initial deposit is non-refundable, and the Client will be liable for any additional costs incurred up to the date of cancellation.

PRODUCTION TIME

Timeline: An estimated timeline for completion will be provided upon approval of the final design. Kali Forbes will make every effort to adhere to this timeline. However, for commissions such as wedding rings with a specific wedding date or engagement rings with a proposal date, it is imperative that the Client communicates these dates during the initial consultation. Kali Forbes will prioritise these deadlines but cannot guarantee completion by the specified date due to unforeseen circumstances.

Updates: Kali Forbes understands the importance of discretion, especially for surprise proposal commissions like bespoke engagement rings. Clients will receive regular updates on the progress of their bespoke jewellery. Every effort will be made to communicate updates discreetly, but clients should be aware that email or message notifications and images related to the commission may be visible to their partners. It is the client's responsibility to manage any potential surprises accordingly.

MATERIALS & QUALITY

Materials: Kali Forbes uses only high-quality materials sourced from trusted suppliers. Each piece of jewellery is meticulously handmade, and slight variations in form and material are inherent characteristics that contribute to its unique charm and artisanal quality.

Design Integrity: Kali Forbes designs jewellery with the intention that it be worn and cherished for a lifetime and beyond. However, natural variations in precious materials mean that pieces may wear over time or be damaged if proper care guidelines are not followed.

Quality Assurance: Kali Forbes guarantees the craftsmanship and quality of each bespoke jewellery piece. Any defects in materials or workmanship will be addressed in accordance with our warranty policy.

Care Guidelines: Clients will receive verbal care guidelines specific to their commissioned piece during the design consultation stage, ensuring its longevity and beauty. Additional jewellery care advice is available on our website to further assist clients in maintaining the integrity and brilliance of their jewellery.

DELIVERY & COLLECTION

Delivery: Completed bespoke jewellery can be delivered to the Client's specified address or collected from Kali Forbes' premises. Delivery charges may apply.

Collection: If collecting in person, the Client must provide identification and proof of payment.

WARRANTY & REPAIRS

Warranty: Kali Forbes stands behind the craftsmanship and quality of our bespoke jewellery. Each piece is meticulously designed to be cherished and enjoyed. Our jewellery is crafted from high-quality materials and should be treated with care to maintain its beauty.

One-Year Warranty: We offer a one-year warranty on all jewellery from the date of purchase. This warranty covers manufacturing defects and craftsmanship issues. It does not cover damage resulting from mishandling, accidents, or repairs performed by another jeweller.

Repair Services: Beyond the warranty period, we provide repair services on a case-by-case basis. Costs for repairs will be quoted based on the specific requirements of the jewellery piece. We strive to ensure your jewellery remains as stunning as the day you first received it.

INTELLECTUAL PROPERTY

Design Rights: All design rights and intellectual property relating to the bespoke jewellery remain the property of Kali Forbes. The Client may not reproduce or commission copies of the design without prior written consent.

PRIVACY & CONFIDENTIALITY

Privacy: Kali Forbes respects the Client's privacy and will handle all personal information in accordance with our privacy policy.

Confidentiality: All bespoke jewellery designs and related communications are treated as confidential.

LIABILITY

Limitation of Liability: Kali Forbes' liability for any claim arising from the commission of bespoke jewellery is limited to the amount paid by the Client. Kali Forbes is not liable for any indirect or consequential losses.

GOVERNING LAW

Jurisdiction: These terms and conditions are governed by the laws of England and Wales. Any disputes will be resolved under the jurisdiction of the courts of England and Wales.

By commissioning bespoke jewellery from Kali Forbes, the Client acknowledges that they have read, understood, and agreed to these terms and conditions.

3. SHIPPING & RETURNS POLICY

SHIPPING

Shipping within the UK: Kali Forbes offers free shipping within the UK on purchases made through this website. UK orders are shipped using Royal Mail Special Delivery and are trackable and insured. Depending on the quantity of items in your order, we may dispatch items in more than one parcel.

Dispatch Time: If the item is in stock at the time of purchase, we aim to dispatch the order within 3 working days. Royal Mail Special Delivery is guaranteed by 1 pm the following day, Monday to Friday. There are some exceptions to this service; specific UK postcodes that are exempt from these time frames can be found on the Royal Mail website here.

Pre-Orders:

The lead time for pre-orders is typically 4-6 weeks, though sometimes it can be quicker. If you have a specific date in mind, please get in touch before placing the pre-order, and we will let you know if it's possible to meet your timeline.
Once your pre-order item is ready to be shipped, we will notify you via email.
Please note that pre-order dispatch dates are estimates and may be subject to change. We will keep you updated with any changes to the expected dispatch date.
Once a pre-order item has been dispatched, it falls under our standard returns policy.

International Shipping: If you would like to purchase something to be delivered outside of the UK, please get in touch by emailing info@kaliforbes.com and we will try our best to fulfil your order. If it is possible for us to fulfil your overseas order, goods are delivered DAP/DDU. This means any customs duties or local taxes (including VAT for EU customers) must be paid by the customer upon import. There may also be a fee charged for customs clearance by the shipping company, which varies from country to country.

RETURNS

Notification of Return: In accordance with UK law, we accept unwanted item returns for a full refund on products purchased from this website. Notification of the return must be sent to info@kaliforbes.com (including proof of purchase) within 14 days of delivery.

Return Conditions

Items must be returned to us within 14 days of notification from the customer.
We must receive the items in an unworn, fully resaleable condition, and in their original packaging.
In keeping with UK law, there are certain items that are exempt from the returns policy (see below for details).
Return shipping costs are the responsibility of the customer.
Once we have received the goods back, we will process the refund using the same payment method used to place the order.

Return Shipping: We advise you to return orders using a trackable, insured service (such as Royal Mail Special Delivery). It is your responsibility to ensure that we receive the returned goods undamaged. We will not issue refunds for lost goods or goods damaged in transit back to us. The cost of the return must be paid for by the customer.

Pre-Order Returns: Pre-order items, unless they were for a custom ring size, can be returned under the same conditions as in-stock items.

In-Person Returns: If you would prefer to return items to our London Studio, this can be arranged in most cases. Please enquire about this option when notifying us of the return.

Exchanges for Different Ring Sizes: Where available, we offer exchanges for different ring sizes. To initiate an exchange for a different ring size, please notify us by emailing info@kaliforbes.com within 14 days of delivery, providing proof of purchase. The ring must be returned to us in an unworn, fully resaleable condition, and in its original packaging within 14 days of this notification. Once we receive the ring back, we will process the exchange for the new size. Return shipping costs for the exchange are the responsibility of the customer.

Exemptions
The following purchases are exempt from the returns policy unless they have suffered a manufacturing fault:

Bespoke pieces (including heirloom remodels)
Customised pieces (e.g., resized rings, engraved jewellery)
Earrings or other pierced jewellery
Orders for custom ring sizes

Extension of Time Periods
All time periods given in these policies will be extended to the next working day if they end on a Saturday, Sunday, or Bank Holiday.

Warranty Repairs: We are pleased to offer a one-year warranty on all Kali Forbes jewellery from the date of purchase, provided the piece has not been altered by another jeweller and the damage falls within normal wear and tear. Before returning an item for repair, please contact us for detailed guidance on the process.

Post-Warranty Repairs: Should your jewellery require repair beyond the warranty period, we will assess each piece on a case-by-case basis. To begin this process, please email us with detailed photos and a description of the issue. We are dedicated to ensuring your satisfaction and will endeavour to accommodate your needs.

Annual Aftercare Appointment: For engagement rings and fine jewellery crafted by Kali Forbes, we offer a complimentary annual setting check and light professional cleaning. Book an aftercare appointment through our Visit page or contact us for further assistance. Please note, if deeper issues are identified during this check, repair costs will be chargeable. You may be required to provide proof of purchase.

Professional Jewellery Cleaning: We offer deep cleaning services that may involve removing gemstones, retipping settings, and reapplying finishes. To begin this process, please contact us via email to assess the possibility of a deep clean. Due to the unique nature of jewellery, we cannot provide a quote for professional cleaning services until we have conducted a thorough inspection of your piece.

Refinishing and Replating Services: Matte and textured precious metals will become shinier with wear, and polished metals will develop a gentle patina over time, adding to their natural character. While we appreciate this characteristic, periodic refinishing is available if preferred. For gold vermeil and plated jewellery, careful maintenance is essential. For replating and refinishing services, please contact us via email.

Ring Resizing: For rings purchased from our website that do not fit, we offer exchanges where available and returns within 14 days of receipt. Please refer to our Shipping & Returns Policy for further details.

For bespoke engagement rings commissioned for surprise proposals, we offer one complimentary resize following the proposal. Similarly, one complimentary resize is typically included for bespoke rings gifted as surprises. Refer to our Bespoke Terms or contact us for more details.

Heirloom Remodels: We take great pleasure in reimagining sentimental heirloom jewellery to suit your taste and style preferences. It is often possible to work with heirloom gemstones, and sometimes, we can repurpose the precious metal. To discuss reimagining your heirloom piece, please email us with detailed photos and material information, or book a design consultation at our London studio.

REPAIRS OF NON-KALI FORBES JEWELLERY

In line with our commitment to sustainability and conscious crafting, we consider repairs of jewellery not originally made by us. However, we recommend contacting the original maker first. If this is not possible, email us with detailed photos and material information. We may request that you deliver the item to our studio for a thorough inspection to determine feasibility.

Important Considerations:

You are responsible for all repair costs, including delivery to and from our studio.
We do not offer a guarantee or warranty on items not originally made by us.
We are not responsible for repairs that do not fit if we have not personally fitted the item.
We are not liable for any damage to jewellery not made by us during the repair process. Unexpected materials or construction methods may cause faults to appear during repairs, and any repair costs for these faults will be your responsibility.
Given the variability in jewellery repairs, we are unable to provide a guide price before a thorough inspection.

Resizing Considerations:

The ability to resize a ring depends on its design, material, and any gemstones.
We are not responsible for resizes that do not fit if we have not personally fitted the ring.
We are not liable for any damage to jewellery not made by us during resizing. Unexpected materials or construction methods may cause faults during resizing, and repair costs for these faults will be your responsibility.

Ring resizing starts at £65 and may increase based on the complexity of the piece, the amount of adjustment needed, and the materials used.
